Problematika příčinné souvislosti při wrongful birth a wrongful life žalobách

Abstrakt: Wrongful birth a wrongful life žaloby představují obtížné téma, jak v rovině právní, tak v rovině společenské a morální. V rámci tohoto článku se autor soustředí ryze na rovinu právní s tím, že i zde oblast zkoumání zužuje na oblast kauzálního nexu. Na jednotlivých případech z oblastí Wrongful birth a wrongful life se pa snaží poukázat na základní problémy stanovení kauzálního nexu u tohoto typu žalob. Na závěr autor konstatuje, že zatímco u wrongful birth nároků je stanovení kauzálního nexu možné, v oblasti wrongful life nároků je tato možnost více než sporná.
Abstract: The paper considers the status of the wrongful birth and wrongful life actions in the light of the principles of recent tort law doctrines and primarily focuses on the problem of causation. After the analysis of recent cases the paper considers that the hurdle of causation is especially in the cases of wrongful life actions not adequately overcome and therefore the acceptance of this type of cases is still questionable.
